Nichia files YAG patent infringement lawsuits seeking injunction and damages against Brazilian distributers of Everlight products
On November 13, 2019, Nichia Corporation (“Nichia”) filed two patent infringement lawsuits in the Judicial District of the Capital of the State of São Paulo against two Brazilian distributers of products of the Taiwanese LED manufacturer Everlight Electronics Co. Ltd. (“Everlight”), namely Karimex Componentes Eletronicos Ltda. (“Karimex”) and Arrow Brasil S/A (“Arrow”).
In both lawsuits, Nichia claims that Karimex and Arrow infringe Nichia’s Brazilian YAG patent PI9710792-1, seeking an injunction and damages caused by the accused infringement. Nichia’s Brazilian YAG patent has not expired, and is still in force.
The products that Nichia accuses in the lawsuits are the following Everlight’s products: (i) 67-21S/KK5C-H6565N32P02833Z6/2T(EMM), 67-21S/KK6C-E3026C6/DT(EMM), 67-21S/KK6C-E6528C6/DT(EMM), 67-21ST/KK5C-E5765E15/DT(EMM) and 67-21ST/KK5C-H6565R4R72834Z15/2T (accused in the lawsuit against Karimex); and (ii) EAHE5630WE03, EZHV-K51C4-2LPGS-F5700(AK) and 67-21S/KK6C-E6528C6/DT(EMM) (accused in the lawsuit against Arrow).
Nichia seeks to protect its patents and other intellectual property rights and takes action against alleged infringers in any country where appropriate and necessary.
